General Terms of the Online Shop

 

The present website and the online shop that sells online the OFILIA’S Products (hereinafter the “Shop”) under the name “OFILIAS., based in Greece, at Georgiou Papandreou 87, Goudi, Zografou. These General Terms of Transaction (hereinafter “GTT”) are intended to express in a clear, concise and comprehensible manner, in accordance with the principle of good faith and the provisions governing the validity of legal acts, the conditions governing and regulating the Company’s relations with each visitor and/or customer of the Shop, in accordance with Law 2251/1994 on “Consumer Rights”, in particular the provisions regarding distant trading and Law 2472/1997 on the “Protection of the individual against the unlawful processing of personal data”, as in force today.

Each time you login, navigate and make a transaction with our Shop makes you a visitor and/or customer of the Shop. Before you start browsing the Shop, please confirm that you have read and understood fully the present GTT and that you accept them, as well as that all uses and/or transactions hereinafter with the Company through the Shop presupposes your full and unconditional acceptance of these GTT.

 

Personal Data

The Company confirms that it will not utilise your personal data for any use not explicitly authorised by you, nor will it send or disclose the said data to third parties (natural persons or legal entities) not affiliated with the Company without your prior explicit and specific consent to do so, unless such disclosure is required for the processing of your order (e.g. collaborating courier companies) or is mandatory by law.

However, for the initiation and processing of our transaction, you will be required to provide certain personal data, such as your name and surname and your contact details, your payment details (e.g. your credit card number), the shipping address for your order etc. In addition, while navigating in the Shop using your personal account, the Company may collect information from your computer’s operational system, your browser and your IP address in order to count visits, to create order history and consumer interest for the purposes of service optimization or maintaining an internal accounting file.

Under-aged visitors may only have access to the Shop and its services pursuant to the consent and under the supervision of their parents or guardians, without any obligation to submit their own personal data. In case such personal data is submitted by under-aged persons, the Company immediately deletes the corresponding information.

The Shop allows its visitors/customers to have access to the file where their personal data are collected and stored according to the above and make any corrections, deletions, modifications and additions to the data or information they have submitted.

Please be advised that we do our best to protect your personal data and that Safe Browsing at our Shop as well as password protection in your personal account is also up to you.

In this case, it is clarified that the Company and the Shop are not responsible for any content of any linked website and their use by visitors/customers as they are beyond the control of the Shop and the Company. Indicating such links does not imply a statement by the Company regarding the reliability, security and content of the particular links, services and products provided through them and their use is the sole responsibility of the visitors/customers. Therefore, for any problem that may come up while navigating at those linked websites or in relation to your transactions with these, please contact directly their administrators, who bear sole responsibility for such websites.

 

Liability of Parties

All visitors/customers, when accepting these GTT and browsing our Shop, state that they have the legal right to conclude this agreement and use the Shop according to the terms and conditions stated herein. Moreover, as a visitor/customer of the Shop you agree and accept that you have the financial responsibility of using the Shop as well as the use of the account by others, including people living with you, so you agree to supervise any use of the Shop by minors using your account or your name. The Company, including its consultants and employees, is solely is solely liable for fraud and gross negligence and solely for damages incurred and its liability may not exceed the value of the sold Products.

 

Applicable Law and Other Terms

The Company and the Shop reserve the right to modify or renew in writing the present GTT without notice, which will be valid from the date of their posting in the Shop. Failure to exercise any right of the Company may not be construed as a waiver thereof.

Navigating, using and making transactions in the Shop is governed by Greek law, the law of the European Union, and the relevant international conventions. Any dispute arising while you navigate, use or make transactions with the Shop shall be subject to the jurisdiction of the competent courts of Athens, Greece.

If any provision of the aforementioned terms conflicts with the law, it will automatically cease to be in force and removed from the present without in any way prejudicing the effect of the other terms.

The Company, complying with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes, Directive 2013/11/EU of the European Parliament and of the Council on alternative dispute resolution for consumer disputes and Ministerial Decision No. 70330οικ. (Government Gazette vol. B’ 1421/2015), informs you that you have the right to out-of-court dispute settlement of any dispute related to your transactions with the Store through the European Online Dispute Resolution (ODR) platform
